The decision by US Dist Judge Michael Farbiarz in Newark, NJ, means any appeals in the #Palestinian #activist's case will be heard by the 3rd Circuit Court of Appeals, which has a 6-6 split between active judges appointed by Republican & Democratic presidents, instead of the #5thCircuit, the country's most #conservative appeals court.

Trump administration admits it deported an immigrant by mistake and refuses to make any move to bring him back. This can be used for the deportation of legal citizens.
ICE is not bothering with immigration courts. Maybe DOGE will fire the judges and save money there.

David Larson, who splits his time between Fort Myers, Florida, and outside Minneapolis, didn't vote for Trump but fully supports removing undocumented migrants who have committed crimes "by whatever means," he said. It gives him no pause, he added, that some of the men rounded up by immigration officials over the weekend may not have been in a gang or committed a violent offense. "He's going full speed ahead, which, there is something to be said about that," Larson said. "There's a lot of times in Washington things just get bogged down, and people keep talking, talking, talking, and nothing happens." Larson said he hasn't been able to convince himself to vote for Trump in the past three elections, voting Libertarian each time instead.

But the president has a key ally in the matter: public opinion. Most Americans say they are in favor of deporting undocumented immigrants who have committed crimes, violent or not. Even some who didn't vote for Trump or embrace his agenda have found it difficult to argue against the notion of rounding up and deporting migrants whom Trump has described as criminals associated with violent gangs. And some support the roundups if they swept up those whose only known crime was entering the U.S. illegally. According to a Washington Post average of polls from the past month, 51 percent of Americans approve of Trump's handling of immigration - marks that may reflect the popularity of mass deportations in general. Though the #Trump admin first claimed that they sent the man to the El Salvador prison in error, the WH Press Secretary, Karoline Leavitt, stated in today’s press briefing that the man was actually a dangerous gang member (based on information she said that she saw behind the scenes).

Abrego Garcia, who lived in Maryland with his wife and child, both U.S. citizens, denies any gang affiliation. Abrego Garcia hasn't been charged or convicted of a crime. After he was arrested, he was put in a staging area meant for people who were going to be deported and was placed in a manifest of passengers meant to be removed to El Salvador, said Cerna. "This was an oversight, and the removal was carried out in good faith based on the existence of a final order of removal and Abrego-Garcia's purported membership in MS-13," Cerna said. Abrego Garcia's lawyer said his client's deportation was carried out without legal authority.
