One of the critiques of the proposed California alternative pathway to licensure is that it will create a "two-tiered" system in which attorneys who become licensed without taking the traditional bar exam will face discrimination.

I hate to break it to the critics but the legal profession is already a tiered system rife with discrimination. Let me count the ways. 1/

I struggle with the balance between free speech and the flood of disinformation. I had the opportunity to read Jeff Kosseff's new book Liar in a Crowded Theater. He offers a persuasive argument about why false speech should be protected. As you can hear during the interview--I am still struggling with it. I understand his argument logically but emotionally I struggle.

It was wonderful to speak to Lisa Kloppenberg, the author of The Most Beloved Thing is Justice, about her friend & mentor Judge Dorothy Wright Nelson.

Judge Nelson barreled through glass ceilings. (She was on the short list for #SCOTUS in 1973!) It is a story of hope in the #law, something often missing today. It also describes how Judge Nelson's Bahá’í faith influenced her approach to the law & conflict resolution.

I don't believe that the two-day bar exam measures competence to practice law. I think it is a measure of who is good at standardized exams. Based on a arbitrary score, an individual can open a practice and represent clients in areas never even tested on the exam.

The CA State Bar BoT will consider a proposal for an alternative pathway to licensure.

I hope you will read the full proposal. It's time we measured what matters.

When I had the chance to interview Dr. Peniel Joseph, a history professor at UTAustin, I asked him if SB17, the law banning #DEI initiatives, made him consider leaving Texas. He said, he wasn’t leaving. “Texas is ground zero for these fights.” I respect that answer and I wonder if I would give the same one.
